These Terms of Service (“Terms”) govern your access to and use of our Site and any digital products, content, courses, community access, downloads, templates, and related services we offer (collectively, the “Services”). By visiting, purchasing from, creating an account, or using any part of the Services, you agree to these Terms.

If you do not agree, do not use the Services.

1) Who we are and what we sell

Millennial Pregnancy provides educational digital products designed to help individuals and couples understand and organize the financial and emotional realities of preparing for pregnancy and parenthood. Our offerings may include:

  • Digital workbooks and templates (including spreadsheets)

  • Video lessons and written guides

  • Educational frameworks and examples demonstrating how to use our materials

  • Access to a community space hosted on Podia (the “Community”), if included with your purchase

We do not provide investment, legal, tax, medical, or mental health treatment services. See Section 10 (Disclaimers).

2) Eligibility (Age requirement)

You must be 18 years or older to purchase or use the Services. By using the Services, you represent and warrant you are at least 18.

3) Platform providers and third-party services (Podia, Stripe, etc.)

Our Site and product delivery are hosted by Podia. Payments may be processed by Stripe or another payment processor. Your use of those third-party services may be subject to their separate terms and policies.

We are not responsible for outages, errors, or interruptions caused by third-party platforms, payment processors, internet providers, or services outside our control.

4) Accounts, login, and access

Some Services require an account and login. You agree to:

  • Provide accurate information when creating an account

  • Keep your login credentials confidential

  • Notify us if you believe your account was accessed without permission

You are responsible for all activity under your account.

5) Purchases, pricing, taxes, and billing

A. Pricing

Prices are displayed on the checkout page at the time of purchase. We may change pricing at any time, but changes will not affect completed purchases.

B. Taxes

You are responsible for any taxes, duties, or VAT/GST that may apply based on your location.

C. Payment processing

Payments are processed by a third-party processor. If your payment fails, access may be suspended until payment is successfully completed.

D. Chargebacks

If you initiate a chargeback without contacting support first, we may suspend your access while we investigate. We reserve the right to provide the payment processor with evidence of delivery/access (e.g., login records, download/access logs).

6) Digital delivery and no shipping

Our products are delivered digitally through the Site (downloads, streaming, member access). We do not ship physical goods unless explicitly stated on the checkout page.

7) Refund policy (Refund Option B)

Because our products are digital and accessible immediately after purchase, all sales are final except as described below.

A. Technical access issues

If you cannot access a product due to a verified technical problem on our side (for example, the file will not download or the course will not open), contact support at support@millennialpregnancy.com within 14 days of purchase. We will work with you to restore access.

If we cannot resolve the issue within a reasonable time, we may, at our discretion:

  • Provide a replacement file/access method, or

  • Issue a refund to the original payment method

B. No refunds for preference or results

We do not offer refunds for:

  • Change of mind

  • Lack of use

  • Personal preference

  • Dissatisfaction with outcomes or results

C. Subscriptions (if applicable)

If you purchase a subscription, you may cancel future renewals at any time through your account settings. We do not provide prorated refunds for time already billed unless required by law.

(Some jurisdictions provide mandatory consumer rights. Nothing in these Terms limits rights you may have that cannot be waived under applicable law.)

8) Community access and community conduct (if included)

Some purchases may include access to the Community. Unless otherwise stated on the checkout page, Community access is included with all purchases.

We may organize community spaces by topic or product, and we may change the structure at any time.

A. Community rules

You agree not to post, share, or upload content that:

  • Is illegal, threatening, harassing, hateful, or defamatory

  • Contains pornography or sexually explicit content

  • Contains private personal data of others (addresses, phone numbers, IDs, payment data)

  • Contains malware, phishing links, or harmful code

  • Infringes intellectual property rights

  • Encourages unsafe or unlawful activity

B. Moderation and removal

We may remove content, restrict posting privileges, or suspend/terminate community access at any time if we believe you violated these Terms or created risk for other members.

C. Member content license (Community posts)

If you post content in the Community (“User Content”), you grant us a non-exclusive, worldwide, royalty-free license to host, display, and distribute that content within the Community and as needed to operate the Services. You remain responsible for what you post.

9) License and intellectual property

All course materials, templates, downloads, written content, branding, and media are owned by us or our licensors and are protected by intellectual property laws.

A. Personal use license

When you purchase, we grant you a limited, non-transferable, non-exclusive license to access and use the materials for your personal use only.

B. Prohibited uses

You may not:

  • Resell, share, distribute, or publicly post our materials

  • Upload the files to public drives or marketplaces

  • Create derivative products for commercial use

  • Remove watermarks or copyright notices

  • Use our materials to build a competing product

10) Educational disclaimers (financial, legal, medical, and psychological)

Our Services are for education and informational purposes only.

A. Not financial, investment, tax, or legal advice

We do not provide financial planning services, investment recommendations, tax advice, or legal advice. Any examples, scenarios, or frameworks are general and should not be treated as personalized professional guidance.

B. Not medical advice

We do not provide medical advice, diagnosis, or treatment. Any healthcare topics (including pregnancy planning, insurance concepts, or general healthcare considerations) are general education only. Always consult qualified healthcare professionals for medical decisions.

C. No guaranteed results

Your outcomes depend on your personal situation and decisions. We do not guarantee any specific results.

11) Availability, updates, and changes

We may update, modify, or discontinue any part of the Services at any time, including course modules, templates, and community features. We may also release updates to improve clarity or fix errors.

We do not guarantee uninterrupted access. Scheduled maintenance, platform outages, or internet failures may occur.

12) Termination and suspension

We may suspend or terminate your access (including community access) if:

  • You violate these Terms

  • You attempt fraud, abuse, or chargeback misuse

  • Your activity creates risk for other users or the platform

Upon termination, your license ends and you must stop using all materials.

13) Disclaimer of warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

14) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SPECIFIC PRODUCT OR SERVICE IN THE 30 DAYS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

(Some jurisdictions do not allow certain limitations. In those cases, limitations apply to the maximum extent permitted by law.)

15) Indemnification

You agree to indemnify and hold harmless the Company from claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of:

  • Your use of the Services

  • Your violation of these Terms

  • Your User Content

  • Your infringement of any rights of another person/entity

16) Governing law and venue

These Terms are governed by the laws of the State of South Carolina, excluding conflict-of-law rules.

If arbitration does not apply (or is not permitted), you agree that disputes will be brought in the state or federal courts located in South Carolina, and you consent to jurisdiction there.

17) Arbitration and class action waiver (optional but recommended)

If you want this section, keep it. If you prefer simpler terms, you can remove it and rely on Section 16 only.

Except where prohibited by law, any dispute arising out of these Terms or the Services will be resolved by binding, individual arbitration and not in court. You and we waive any right to a jury trial and any right to participate in class actions or class-wide arbitration.

You may bring claims in small claims court if your claim qualifies.

(If you want, I can tighten this section to match your preferred venue and make it cleaner, but this version is already usable.)

18) Force majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including outages of Podia/Stripe, internet failures, hosting issues, natural disasters, labor disputes, war, terrorism, government actions, or other force majeure events.

19) Assignment

We may assign or transfer these Terms and our rights/obligations (for example, if we reorganize, sell assets, or change platforms). You may not assign these Terms without our written consent.

20) Severability

If any part of these Terms is found invalid or unenforceable, the remaining provisions remain in full force.

21) No waiver

If we do not enforce a provision of these Terms, that does not waive our right to enforce it later.

22) Headings

Headings are for convenience only and do not affect interpretation.

23) Entire agreement

These Terms (plus any posted policies referenced on the checkout page, including the Refund Policy above) are the entire agreement between you and us regarding the Services and supersede prior discussions or understandings.
